ARTICLE 1: The field of application of the terms of sale

The present General Conditions of Sale apply to all the sales concluded by means of the www.eFinalVinyl.com web site.

ARTICLE 2: The Availability of Inventory

These second-hand, one-of-a-kind, original pressings of records or CDs are in most cases available as single copy previously-owned items only. They are not digitized or new copies. eFinalVinyl.com cannot guarantee the delivery of an item if the number on order exceeds the number of copies per item listed in the store.

ARTICLE 3: Prices

Prices are indicated in US dollars at current exchange rates and do not include shipping costs. Prices may be changed at any time without notice, and all items will be charged at the current basis at the moment an order is processed. The price is payable at once and in a single payment at the time the order is placed. All orders are charged and payable in US dollars only. For any delivery outside the continental United States, possible customs charges or local taxes may be chargeable to the addressee.

ARTICLE 4: Shipping Fees

Shipping fees include fixed packaging costs as well as variable costs per item(s) for shipping depending on the carrier. In most cases it may be preferable for the customer to gather items into one single order to reduce costs. We cannot group together two or more orders, shipped to different destinations in order to qualify the customer for FREE shipping. In that case shipping fees will be charged for each order. ARTICLE 5: Payment Method

All orders are payable immediately upon confirmation in US dollars. The customer may make payment via an ACH bank to bank transfer using Bank Deposit USA, via credit card through PayPal, Amazon Payments, or via a personal check using the links provided during checkout process. If you use the PayPal payment option DO NOT process your payment via the Firefox browser, as Firefox tends to produce timeout errors. Use another browser such as Internet Explorer, Chrome, Safari, or one of our other payment options cited above during the checkout process.

The customer guarantees to eFinalVinyl.com that he/she is fully authorized to use the method of payment which is chosen during the ordering process.

eFinalVinyl.com reserves the right to suspend or to cancel any order or shipment, at whatever nature or stage of completion, in case of nonpayment of any sum which would be due by the customer.

The delivery of any new order can be suspended in case of a delay in the payment of a previous order. eFinalVinyl.com reserves the right to ask for a photocopy of the customer’s ID card for any payment by bank card. Within the regulations concerning Internet fraud and in keeping with security criteria established by the Payment Card Industry (PCI), confidential credit card information concerning your order is never kept locally, however information as to a customer’s name and address can be passed on to third party for verification purposes.

Secured payment:
For your safety, secured PCI compliant payment services are currently provided through either personal check or ACH bank to bank transfer through the Bank Deposit USA service; and via PCI compliant credit card service through either Amazon Payments or PayPal.Please note that the PayPal Express Checkout service does not work properly with the Firefox browser. See above for alternative solutions. All the private data concerning you and your bank account information are protected by these services. eFinalVinyl.com does not store or share any of your personal or financial information. eMail addresses are required solely for online access to our servers for customers to track their order history and/or to post comments or reviews.

ARTICLE 6: Shipping

We will deliver your order by USPS mail. The delivery time includes the time of validation of your payment, and the preparation of the parcel (24 hours maximum) as well as the time of routing. The average delivery time between the ordering and the receiving of your parcel is about 3 or 4 days for local Michigan addresses, 4 to 8 days for other states, but it is not a deadline and eFinalVinyl.com is not responsible for possible shipping delays, especially to distant countries. If the state or country of delivery is not correctly indicated into your profile, there may be further delays

ARTICLE 7: Guarantee : satisfied, exchanged or refund

All records proposed on this site are second-hand records such as you would find in a second-hand record dealer’s or at a garage sale. Meaning a second-hand record is an already used record, which level of condition is described during the sale.

According to the U.C.C., the seller protects the buyer, in any case, from all the harmful consequences of any latent defects with the sold goods, under the reservation that any such defects have been previously indicated to the buyer from their physical appearance description. In any case, the buyer will have to disclose the evidence of such defects on the day of the delivery. The expenses of any returns will be paid by the buyer and the exchange must be done as soon as possible.

The buyer then has the right to return goods within seven days following the receipt of shipment (in its packaging and with the corresponding invoice), notifying us the motive for return, indicating the invoice to which the shipment refers to the following address :

ARTICLE 8: Right of revocation

Within the customary practices for online sales, the consumer has a seven (7) days period to apply his right of revocation without having to prove motives or to pay any penalties, with the exception of the expenses for returning the goods he has ordered. The period above goes from the reception for the items ordered. When the period of seven days expires on a Saturday, a Sunday or a Bank holiday, it is extended until the next first working day.

ARTICLE 9: Transfer of ownership and transfer of risks

The transfer of ownership of products for the benefit of the buyer, will be completed only after full payment of the price for the full order, the delivery date the aforementioned order notwithstanding. On the other hand, the transfer of risks for loss or damage to the products in said order will be completed upon the delivery and acceptance of the aforementioned products by the Buyer.

The titles contained in the eFinalVinyl.com database were entered according to the information communicated by the music publishers using reasonable ratings for quality and/or market availability. eFinalVinyl.com is not responsible for the contents of the works themselves and has no responsibility for this content towards the buyer.
The proposed products eFinalVinyl.com declines any responsibility for delivered items that do not respect the legislation of the country of delivery (censorship, ban on a title or on an author).

eFinalVinyl.com is not responsible for non-fulfillment of the contract because of natural disaster (earthquake, flood, fire,…) or extraordinary event (strike, terrorism action, transportation accident,…). eFinalVinyl.com is not responsible for the contents of the sites from which the hypertext links are send back from its own site.

ARTICLE 12: Applicable right

All clauses appearing in these present General Conditions of Sale, as well as all the aforementioned articles of purchase and sale, are subject to the applicable laws of United States, in which eFinalVinyl.com is located, and where the contract between the parties is assumed to be established.

ARTICLE 13: Acceptance of the buyer

These present General Conditions of Sale as well as these published price lists are expressly approved and accepted by the buyer, who declares and recognizes to have a complete knowledge of, and who relinquishes the right, therefore, to take advantage of any contradictory document and, notably, his own general conditions of purchase, such act of purchase culminating in the acceptance of these present General Conditions of Sale.

The present conditions are modifiable at any time without advance notice.
